After reading this excellent post https from tuckerm33 about TH's car key. I said I would show the images to my cousin who is a locksmith. Get a professionals opinion on it. He said ' That is a valet key from a RAV4 it's a non transponder key that's why the head is so small and they didn't just get it cut from a blank because there is wear on it. What you need to find out is had her car got a factory fit transponder immobiliser on it if it had that key would not have started her car' I did a Google search to confirm the difference between a non transponder key and a genuine Toyota key. Notice the difference between the two type of keys.
There is no doubt the key found was the non transponder type. Take a look at key they found here So the big question now is did TH's car have an immobiliser fitted. I don't know if anyone has answered this question before and I'd like to think the defence has checked that the key actually could start the car but with this case you never know anything is possible! That key was super controversial for the prosecution. Kratz just about admits it's planted in closing. He had to deal with it but not deal with it so he wasn't motivated to promote or press the key issue, that would have been up to the defense to exploit and for them they were better off in theory with a key that was hers and worked that didn't have her DNA on it. That perception for the jury should have spoke volumes but as we know.otherwise the prosecution says, key didn't work, wasn't hers, lots of keys there but who cares about keys her car is there.
We don't really know all the DNA that was on that key. We know what was 'reported'. I am slowly learning about the shady world of 'forensic' DNA, which I now separate from 'science'. It is not about reporting the 'results'. It is about reporting what the prosecution wants you to see. I have read of only one profile being reported from mixed samples.
I am pretty horrified at what I am reading, and I have just scratched the surface. Unless it was soaked in bleach, if this was a key that TH used day after day, I find it hard to imagine, if they could get SA's DNA off of it, there would not be some of hers there, that at least would contaminate his. And if someone intentionally was intending to remove DNA, hard to believe they would be so careless as to take their gloves off and chuck it in their nightstand. There are a lot of things that could have been questioned. I think the defense did the best they could with what they felt was important.
Back then, people were less likely to question DNA evidence, what they think is 'objective science'. Still it doesn't happen. If they had, there would not have been a 'body'. That's one way to look at it and it makes perfect sense. But on the other hand only the killer would have had the key that started the RAV4, if the jury decides it wasn't planted it makes SA the automatic killer. More so than the car being on the property, that one could have been driven there by someone else (who had the real key).

While even the wrong key could have been argued to be planted, then lied about it being Teresa's. Effectively proving it was planted/tampered/misrepresented evidence and not left up to interpretation of the jury. But I agree, even your interpretation of the key conundrum makes perfect sense and I could see both sides thinking that. I'm not exactly sure, if it was indeed her valet key the prosecution could argue SA got the key in the car somewhere or on her person and destroyed (or hidden) her main set of keys, or that she was simply driving with the valet key that day and SA threw away the hob (it the RAV4 had an immobiliser). They could present a rebuttal to that and make an 'honest' claim that the LE thought it was her primary key but were mistaken, a mistake of no 'meaningful' consequence to the case. But if the key isn't even Teresa's that's undeniable misrepresentation of evidence and grounds for a mistrial, retrial or any other equally important repercussion. Edit: but yes, I do agree both would put a big dent into their evidence against SA but if it wasn't her key it's a slam dunk for a mistrial, while if it's her valet key a judge might listen to the prosecution's narrative and deem it not important enough for a re-trial.
